Terms of service

1. Who we are and what these terms cover

These terms are an agreement between you and HerShape ("HerShape", "we", "us"), the developer of the HerShape mobile app for iOS and Android and of this website (together, the "Service"). By creating an account or using the Service you agree to these terms and to our privacy policy, which explains how we handle your data, including your health and cycle information. If you do not agree, please do not use the Service.

2. Who can use HerShape

You must be at least 16 years old to use HerShape. If you are under 18, you should have a parent or guardian's permission. You also need to be able to enter a binding agreement where you live, and to comply with the terms of the app store you download HerShape from.

3. Your account

• Give us accurate information and keep it up to date, especially the health details your plans depend on.
• Keep your sign in details private. You are responsible for activity on your account.
• One account per person. Do not share an account or create accounts for others.
• Tell us at support@hershape.app if you think your account has been accessed without permission.

4. What the Service is, and what it is not

HerShape generates personalised meal plans and workout plans, adapts them to your cycle phase and life stage, tracks your progress, and gives you an AI coach (Coach Sarah) to ask questions and change your plan. Plans and coach replies are produced by AI from the information you give us. They can be wrong, incomplete, or unsuitable for you, so use your own judgement and check anything that seems off.

HerShape is not medical advice. It is not a substitute for a doctor, dietitian, physiotherapist, or other qualified professional, and it does not diagnose, treat, or prevent any condition. Talk to your doctor before starting or changing an exercise or nutrition programme, especially if you are pregnant, postpartum, breastfeeding, recovering from an injury, or managing a health condition such as PCOS, a thyroid condition, diabetes, or an eating disorder.

HerShape is not a contraceptive, fertility, or pregnancy planning tool. Cycle phases in the app are estimates based on the dates you enter. Do not rely on them to prevent or achieve pregnancy.

Exercise carries a risk of injury. Stop and seek help if you feel pain, dizziness, shortness of breath, or anything that does not feel right. By using HerShape you confirm that you have chosen to take part in physical activity and accept that risk.

5. HerShape Pro subscriptions

Some features, including unlimited plan generation, full progress history, and Coach Sarah, require a HerShape Pro subscription. The exact features, prices, and any free trial are shown in the app before you subscribe.

• Billing. Subscriptions are sold and billed by Apple (App Store) or Google (Google Play), not by us directly. Payment is charged to your store account when you confirm the purchase.
• Auto renewal. Your subscription renews automatically at the end of each period, at the price shown when you subscribed, unless you cancel at least 24 hours before the current period ends.
• Free trials. If a free trial is offered, it converts to a paid subscription automatically when the trial ends unless you cancel before then. Trials are limited to one per person.
• Cancelling. Cancel any time in your App Store or Google Play subscription settings. You keep Pro until the end of the period you have paid for. Deleting the app or your account does not cancel a subscription.
• Refunds. Because the stores handle billing, refund requests are handled by Apple or Google under their policies. We cannot issue refunds for store purchases ourselves.
• Price changes. If we change the price of a subscription, the store will tell you before the change applies to you, and you can cancel before then.
• Restore purchases. If you change phones or reinstall, use Restore Purchases in the app while signed in to the same store account.

6. Acceptable use

Please do not:

• Use HerShape for anything unlawful, or in a way that could harm you or others.
• Post offensive, hateful, or misleading names or content in leaderboards or rooms, or impersonate anyone.
• Try to manipulate points, streaks, or leaderboards through false logging or automation.
• Copy, scrape, reverse engineer, or build a competing product from the app, its plans, or its content.
• Interfere with the Service, probe its security, or access other people's data.
• Use the coach to try to obtain content that is harmful, including content that promotes disordered eating.

We may suspend or close accounts that break these rules or put other users at risk.

7. Leaderboards and rooms

Leaderboards are optional. If you take part, other HerShape users can see your first name, your country flag, and your points. Rooms are private groups you join with an invite code, so anyone with a code you share can see your position in that room. Keep your codes to people you trust.

8. Your content and our content

You own the information you enter into HerShape. You give us permission to use it to operate and improve the Service for you, as described in the privacy policy, and nothing more. The plans and coach replies generated for you are yours to use for your personal fitness and nutrition. Everything else, including the app, its design, the HerShape name and logo, exercise videos, and the systems that generate plans, belongs to HerShape or our licensors. We give you a personal, non transferable licence to use the app for its intended purpose while these terms are in force.

9. Third party services

HerShape relies on third parties to run: Apple and Google for distribution and billing, Supabase for hosting and authentication, OpenAI for plan and coach generation, RevenueCat for subscription management, and Expo for push notifications. Their terms apply to their services. We are not responsible for outages or changes on their side, but we will do our best to work around them.

10. Availability and changes

We work hard to keep HerShape available and accurate, but we cannot promise it will be uninterrupted or error free. We may add, change, or remove features, and we may update these terms. If a change is significant, we will tell you in the app before it takes effect. Continuing to use HerShape after a change means you accept the updated terms.

11. Ending the agreement

You can stop using HerShape at any time and delete your account in the app under Settings, Delete Account. This permanently deletes your account and data as described in the privacy policy. Remember to cancel any active subscription in your store settings, as deletion does not do that for you. We may end your access if you seriously or repeatedly break these terms.

12. Disclaimers and limitation of liability

HerShape is provided "as is" and "as available". Fitness and nutrition results vary from person to person, and we do not promise any particular outcome. To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential losses, or for injury or loss arising from reliance on plans or coach replies without appropriate professional advice. Where liability cannot be excluded, our total liability to you is limited to the amount you paid for HerShape Pro in the 12 months before the claim.

Nothing in these terms limits rights you have under the consumer protection laws of the country where you live, and nothing excludes liability that cannot be excluded by law.

13. Governing law

These terms are governed by the laws of the country in which HerShape is established, except that if you are a consumer you also benefit from any mandatory protections of the law where you live. Before going to court, please contact us so we can try to resolve the problem directly.
